Lexie's Law - for students with special needs

Lexie's Law is new legislation designed to rescue children with disabilities and in foster care who were attending the schools of their parents' choosing under two scholarship programs struck down by the Arizona Supreme Court in March, 2009. This legislation created a new corporate and insurance premium tax credit for donations to school tuition organizations providing scholarships to disabled and displaced students Lexie's Law for special needs children (capped at $5 million - the same amount that was previously allocated to the voucher program)

  • It contains several budget-positive components: limits the scholarship awards to 90% of what would be allocated for the student in a public school, requires School Tuition Organizations to award 90% of scholarships to students switching from public schools to private schools
  • Makes a special exception for the 473 students (formerly administered by the Arizona Department of Education) currently utilizing the voucher programs to participate in the scholarships awarded by School Tuition Organizations under the new program and
  • Creates a new corporate tax credit scholarship program so that students with special needs like Lexie Weck, who has autism, can continue to attend the schools chosen by their parents. Without this new law, many of these students would have been forced back into public schools that have previously not met their needs.

This corporate tax credit provides a unique opportunity for insurance companies to take a leadership position in support of these special children. The public relations and political value of providing this help is a side benefit. For a smooth transition, we are coordinating with the Arizona Department of Revenue to facilitate scholarship awards.

HB 2287 enabled employers to voluntarily offer employees the opportunity to participate in the public school, school tuition organization, and charitable tax credit programs by having their withholding tax reduced throughout the year.

Arizona School Choice Trust, Inc. is a "school tuition organization" as defined in A.R.S. Section 43-1089, and as such, must allocate at least ninety percent of its annual revenue for educational scholarships or tuition grants to children to allow them to attend any qualified school of their parents' choice. Up to 10% of all revenues can be used for administration.
